Cancer/Failure to Diagnose
Failure to diagnose refers to a failure of a medical professional to correctly diagnose a medical condition. A failure to diagnose, a delayed diagnosis and other types of misdiagnosis are a common cause of medical malpractice lawsuits. The majority of malpractice cases involve misdiagnoses, diagnostic errors or delayed diagnosis.
These failures can often occur when a patient is seen in the emergency room. Physicians and nurses have the training necessary to detect the symptoms and complications commonly linked to certain diseases and conditions, such as cancer. Often, the key to effective treatment, and even survival, is early detection. Any delay in a patient receiving preventative testing and proper medical care due to physician error that results in harm should be discussed with a lawyer.
Dean Piermattei has handled cases involving the failure to properly diagnose heart attack symptoms or blood clots of individuals who presented to the emergency room. In these cases, the patients were told their symptoms were caused by other conditions and unfortunately the individuals died shortly after their visit to the emergency room because they did not receive the correct diagnoses and treatment. These cases were successfully resolved in favor of the victims' families.
Cancer Diagnostic Errors
Cancer, which is the group name for more than 100 different diseases, is an area where diagnostic errors occur. Each type of cancer has its own symptoms and indications. When a doctor or other professional fails to diagnose cancer because of dismissive behavior or negligence, they may:
- Fail to order a mammogram for patients with suspicious lumps.
- Fail to investigate suspicious skin growths.
- Fail to detect elevated PSA.
- Fail to properly interpret imaging studies of a cancerous mass.
- Fail to interpret tissue samples that indicate cancerous cells.
David Dowling has handled many failure to diagnose cancer cases. A prompt, accurate diagnosis is critical to effective medical treatment.
